Key Terms for Data Protection Policy

1. Applications

means any software, (web) applications, digital tools developed by Daikin Industries (Thailand) Ltd.

2. Automated decision making (processing based solely on)

means any processing carried out through an automatized process, therefore excluding any human influence or intervention with regard to the outcome of said process.

3. Business Partners

means any individual or business which is autonomous from DIT (Daikin Industries (Thailand) Ltd.) but has some degree of involvement in DIT’s business or has run a commercial partnership or cooperates with DIT for the production and/or supply of products/services Daikin branded.

4. Cookie

means a small file containing a string of characters that is sent to the device used for visiting a website. At the second visit to the same website, the cookie may allow that website to recognize the browser through which the visit has occurred. Cookies may store user’s preferences and other information.

5. Daikin Group

means the group of companies controlled by Daikin Industries Ltd. These companies are manufacturers and sellers of Daikin branded products, services worldwide.

6. Data Controller

means a natural person or a legal entity which determines purposes and means of the Processing of Personal Data.

7. Data Processor

means a natural person or a legal entity which processes Personal Data of a given Data Subject under the Data Controller's instructions.

8. Data Protection Officer

means a natural person or a legal entity in charge of.

● informing and advising the Controller and its Processors and employees on the Processing of Personal Data. ● advising on the drafting of Data Protection Impact Assessments. ● acting as a contact point and cooperating with the supervisory authority concerned by a complaint or that is investigating on the Processing of Personal Data;

9. Data Subject

means an identified or identifiable natural person whose Personal Data are processed offline via paper forms or online through Website and Applications. Identifiable means a natural person who can be identified directly or indirectly, namely by means of an identifier such as a name, an identification number, location data, an online identifier or by one or more elements which are characteristic for the physical, physiological, genetic, psychic, economic, cultural or social identity of that natural person.

10. DIT

means the group of companies composed by Daikin Industries (Thailand) Ltd. DIT produces, sells and commercializes Daikin branded products.

11. DIL

means the company Daikin Industries Ltd. with registered office in Japan, owner and controller of Daikin Group.

12. IP

means the number known as an Internet protocol (IP) address which is assigned to any device connected to the Internet. The numbers are usually assigned in geographic blocks. An IP address can often be used to identify the location from which a device is connecting to the Internet.

13. Legitimate Interest

means an interest of the Controller or of a third party which is lawful and is not overridden by interests or fundamental rights and freedoms of data subjects, which require protection of personal data, in particular where the data subject is a child.

14. Joint Data Controller

means a natural person or a legal entity that jointly with others determines means and purposes of the Processing of Personal Data.

15. Personal Data

means any information relating to an identified or identifiable natural person (‘Data Subject’).

16. Processing (of Personal Data)

means any operation or set of operations which is performed on Personal Data or sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

17. Profiling (or Profiling)

means any form of automated processing of Personal Data consisting of the use of Personal Data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects concerning that natural person's performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements.

18. Pseudo-anonymization (or Pseudo anonymous, or Pseudo anonymized)

means the Processing of Personal Data in such a manner that the Personal data can no longer be attributed to a specific Data Subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organisational measures to ensure that the Personal data are not attributed to an identified or identifiable natural person.

19. Public Interest

means any public interest which is laid down by law or pursued by an official authority.

20. Special Categories of Personal Data

means any personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, genetic data, biometric data processed for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person's sex life or sexual orientation.

21. Vital Interest

means any interest which is essential for the life of a Data Subject or of another natural person.

22. Website
